Terms of Service
Effective Date: 18 February 2026
Welcome to Hously ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Hously property management platform, available at hously.com(the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Acceptance of Terms
By registering for or using Hously, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and agree to comply with these Terms and all applicable laws and regulations of Kenya and any other applicable jurisdiction.
2. Description of Services
Hously is a property management software ("PMS") platform that provides the following features to property managers, landlords, and tenants:
- Tenant management and onboarding
- Lease creation and management
- Rent collection and payment processing (via Stripe)
- Maintenance request tracking
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with reasonable notice.
3. User Accounts
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at sam@hously.com if you suspect unauthorized access.
4. User Roles and Responsibilities
4.1 Property Managers / Landlords
If you use Hously as a property manager or landlord, you represent that you have the legal right to manage the properties listed on the Platform, that all lease and tenant information you input is accurate and lawful, and that you will comply with all applicable Kenyan tenancy and landlord-tenant laws.
4.2 Tenants
If you use Hously as a tenant, you agree to use the Platform only in connection with properties where you are a legitimate tenant, and to make payments only through authorized payment methods provided on the Platform.
5. Payments and Fees
Hously currently offers its services free of charge. We reserve the right to introduce subscription fees or transaction fees in the future. We will provide at least 30 days' written notice before any pricing changes take effect. Continued use of the Platform after the effective date of any fee change constitutes your acceptance of the new pricing.
Payment processing services on the Platform are provided by Stripe. By making or receiving payments through the Platform, you agree to Stripe's Terms of Service and Privacy Policy. Hously is not responsible for any errors, delays, or failures in payment processing caused by Stripe or your financial institution.
6. Prohibited Uses
You agree not to use the Platform to:
- Violate any applicable law or regulation
- Submit false, misleading, or fraudulent information
- Harass, abuse, or harm another user
- Attempt to gain unauthorized access to any portion of the Platform or its related systems
- Upload or transmit viruses or any other malicious code
- Scrape, copy, or republish any content from the Platform without our prior written consent
7. Intellectual Property
All content, features, and functionality on the Platform — including but not limited to software, text, graphics, logos, and design — are the exclusive property of Hously or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform solely for its intended purpose. You may not reproduce, modify, distribute, or create derivative works without our express written permission.
8. Data and Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your data as described in the Privacy Policy.
9. Third-Party Services
The Platform may integrate with or link to third-party services, including Stripe for payment processing. These third-party services are governed by their own terms and privacy policies. Hously does not endorse and is not responsible for the content, practices, or policies of any third-party service.
10. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Hously does not provide legal, financial, or real estate advice. Nothing on the Platform constitutes professional advice. You should seek independent professional advice before making any legal, financial, or property-related decisions.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOUSLY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total aggregate liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid to Hously in the twelve (12) months preceding the event giving rise to the claim, or KES 1,000 if no payments have been made.
12. Indemnification
You agree to indemnify, defend, and hold harmless Hously and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your use of the Platform, your violation of these Terms, or your violation of any third-party rights.
13. Termination
We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Platform will immediately cease. Sections 7, 10, 11, 12, and 14 shall survive any termination.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on the Platform and updating the effective date above. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and Hously regarding your use of the Platform and supersede all prior agreements and understandings.
